Tools voor de rechter in geval van een ongeboren vrucht in gevaar.<\/em><\/strong><\/p>\n

Internationaal Verdrag rechten van het Kind (IVRK)
\nIn de preambule wordt aangegeven dat \u201chet kind\u201dbijzondere bescherming met inbegrip van de\u00a0 geeigende wettelijke maatregelen nodig heeft zowel voor als na de geboorte.
\nArtikel e IVRK: het belang van het kind vormt altijd de eerste overweging bij alle maatregelen betreffende kinderen. Dat geldt voor rechters en alle openbare of particuliere instelingen voor maatschappelijk welzijn en voor bestuurlijke en wetgevende organen.<\/p>\n

BOPZ:<\/p>\n

    \n
  1. Als er sprake is van een stoornis bij de zwangere\u00a0 vrouw die gevaar veroorzaakt voor haarzelf\u00a0 en\/of\u00a0 een ander, welk gevaar niet kan worden op een andere manier kan worden afgewend en er rechtstreeks verband is tussen stoornis en gevaar. De rechter kan\u00a0 een maatregel nemen in het kader van de BOPZ( Wet Bizondere opnemingen in psychiatrische ziekenhuizen) Deze maatregel kan zijn een Rechtelijke machtiging : VM voor 6 maanden Art. 1 wet BOPZ tevens op basis van art. 3 IVRK.<\/li>\n
  2. Door deze maatregelen worden de zwangere vrouwen in zorg ondergebracht en daarmee (het leven van ) de ongeboren vrucht veilig gestel: er zullen praktijkvoorbeelden worden en toelichting op de gang van zaken.<\/li>\n<\/ol>\n

    BW<\/p>\n

      \n
    1. Ingeval er sprake is van een ernstig bedreigde ontwikkeling van een ongeboren vrucht van minimaal 24 weken door de levenswijze van haar moeder kan dit \u201ckind\u201donder toezicht (OTS) worden gesteld door de (kir) rechter op basis van\u00a0\u00a0 artikel 1. 254 BW. De OTS kan voor een jaar worden uitgesproken maar ook in geval\u00a0 van spoed voor3 maanden ;dan heet de maatregel VOTS (voorlopig OTS) moet sprake zijn van een ernstige bedreiging van zijn\/haar ontwikkeling vb door overmatig drugs of drank gebruik dan wel ten gevolge van zwakbegaafdheid en ander middelen ter afwending hebben gefaald of zullen falen.<\/li>\n
    2. Toelichting hoe en door welke instanties dit middel\u00a0 kan worden aangewend en aangebracht bij de kinderrechter. Er\u00a0 kan miv de geboorte\u00a0 een UHP (uithuisplaatsing)worden uitgesproken\u00a0 om de risico\u2019s bij de geboorte te beperken.<\/li>\n
    3. Er zullen ook hier enkele praktijkvoorbeelden volgen. Eveneens op deze situatie is\u00a0 art 3 IVRK van toepassing.<\/li>\n<\/ol>\n
