Protection of trafficked minors

Children who were clearly trafficked or where the police or immigration-authorities suspect that they might be a victim of trafficking are most vulnerable. The presentation of dr. Philip Veerman (psychologist) is a plea to make all proceedings more tuned in with the best interests of the child and to get procedures which are less stressful for the child. In order to make the procedures more child-friendly and based on the best interests of the children the text of the Convention (art 35 on trafficking) is found not to be of too much help, because it is rather vague. At least a General Comment on art 35 (trafficking) by the Committee on the Rights of the Child could strengthen this best interests of the child approach and this Chapter calls for such a General Comment as start of  whole process strengthening the rights of child victims. The presentation is based on the experience of the Dutch guardianship-organisation NIDOS. Nidos fulfils the guardianship task for Unaccompanied Minor Asylum Seekers and for the (potential) victims of trafficking. The Dutch system of guardianship was seen as an example of good practice in the publication of the Handbook Guardianship for Children Deprived of Parental Care, which was published in 2014. “Effective guardianship systems are key to preventing abuse, neglect and exploitation” it was concluded.  Veerman is pleading for a General Comment on Trafficking of Minors written by the Committee on the Rights of the Child in order to give more guidance, since art 35 is so vague and not helpful.
